The State of the Law 2005 --Legal Developments Affecting Partnerships between Government and Faith-Based Organizations

This report provides a comprehensive review of recent developments in constitutional and statutory law concerning relationships between church and state.
Three prominent legal decisions this year helped sharpen the boundaries governing
public funding of faith-based organizations -- but many of the lines between church and
state remain blurred and could be the focus of future disputes, according to the findings of the annual State of the Law report issued today by the non-partisan Roundtable on Religion and Social Welfare Policy.
"Although these decisions help clarify some of the lines between church and state
this year, they're likely not the final word," said the report's authors, Law Professors Ira C.Lupu and Robert W. Tuttle. "The reshaping of the Supreme Court that is now underway could dramatically change the legal landscape affecting the public support of faith-based organizations." Lupu and Tuttle, both of whom are experts in constitutional law at George Washington University, serve as co-directors of legal research for the Roundtable.
